Terms of Service

By applying to or using the Hosted platform ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not access or use the Service.

Hosted is an invite-only platform that facilitates connections between content creators and venues for the purpose of complimentary experiences ("comps") in exchange for social media content ("deliverables"). Hosted acts as an intermediary only. We make no representations or guarantees regarding the conduct of any creator or venue, the fulfillment of any comp, or the quality or performance of any content. All arrangements facilitated through the platform are between the participating creator and venue.

The Service is available by invitation only. You must be at least 18 years of age to use the platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information and to keep it current.

As a creator using the Service, you agree to: attend bookings you have confirmed or cancel with reasonable advance notice through the platform; fulfill all agreed deliverables within the timeframe and specifications of each offer; accurately represent your social media presence, audience, and engagement; submit content links through the platform upon posting; and comply with the terms of any applicable social media platform and all applicable laws. Repeated failures to honor bookings, deliver content, or accurately represent your profile may result in suspension or permanent removal from the platform.

As a venue using the Service, you agree to: honor confirmed comps in full as described in your posted offer upon presentation of a valid booking code; post offers that accurately describe the experience, comp value, and deliverable requirements; and fulfill any applicable payment obligations to Hosted as agreed at onboarding. Failure to honor confirmed bookings or material misrepresentation in posted offers may result in suspension from the platform.

All bookings are subject to review and approval by Hosted. A booking is not confirmed until you receive written confirmation with a booking code. Hosted reserves the right to decline, modify, or cancel any booking at its sole discretion. Creators who need to cancel a confirmed booking must do so through the platform. Frequent cancellations may affect your ability to participate in future offers.

Creators retain ownership of all content they produce. By fulfilling a booking, you grant the applicable venue a non-exclusive, royalty-free license to repost and use your content for their own marketing purposes. Hosted does not claim any ownership or license to creator content. You represent that any content you produce does not infringe on the rights of any third party.

Venue access to the platform is subject to fees as agreed at signup. All fees are non-refundable unless otherwise required by law or due to a platform error. Hosted reserves the right to modify its fee structure with reasonable notice to active venue accounts.

You may not use the Service to misrepresent your identity or credentials, circumvent the platform to arrange bookings outside of the Service, harass or harm other users, violate any applicable law or regulation, or attempt to reverse engineer, scrape, or otherwise interfere with the platform. Violation of these prohibitions may result in immediate termination of your account.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. Hosted expressly disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Hosted shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service or any comp arrangement facilitated through the platform. Our total liability to you for any claim arising from these terms shall not exceed the amount you paid to us in the three months preceding the claim.

Hosted may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations incurred prior to termination.

We reserve the right to modify these terms at any time. We will provide notice of material changes by email or through the platform. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised terms.

These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from or relating to these terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
